Scottish Law Commission – Eleventh Programme of Law Reform
The Scottish Law Commission plays a leading role in developing the law for the people of Scotland so that it is just, principled, responsive and easy to understand. The functions of the Scottish Law Commission include recommending reforms to improve, simplify and update the law of Scotland and it has published its most recent programme of law reform.
The programme, which covers the five years from 2023 to 2027, offers an update on several projects that are continued from the previous programme. It includes an update on the work being undertaken on Tenement Law: Compulsory Owners’ Associations which follows on from the recommendations of the Scottish Parliamentary Working Group who had identified the need for the introduction of compulsory owners’ associations as one of a package of measures aimed at improving the condition of tenement stock in Scotland. The Scottish Law Commission is developing the detail of this recommendation, considering which legal entity should be used for owners’ associations, what power and duties they should hold and how these powers can be exercised.
The Scottish Law Commission plans to publish a Discussion Paper, followed by a final Report and draft Bill during the term of the Eleventh Programme.
